For your project to be Exempt Development, in most cases, it has to meet the requirements of NSW State Environmental Planning Policy (Exempt and Complying Development Codes) 2008. You can either check the requirements here or fill in our short questionnaire below and pay a small $30 fee to see if your project can be exempt.
However note that if you can’t meet the rules for Exempt Development, the work will be Complying Development or Local Development. If this is the case and we assist you with preparing a Complying Development Certificate (CDC) or Development Application (DA) , we will refund the cost of the Exempt Development questionnaire.
To make it easy to check if your project can be Exempt Development, we have broken the process up into 3 stages.
Stage 1 – Choose your project type.
Stage 2 – Check if your project is located on land where Exempt Development is not permitted.
Stage 3 – Check that your project can comply with the specific requirements for its category.
To ensure you aren’t wasting your time and money, a report will only be created once you have completed Stages 1 & 2. Once you have done this you will need to pay a nominal fee of $30 (ex GST) to complete Stage 3, where an Exempt Development report will be generated if your project can be Exempt.
