Can your project be Exempt Development?

To help you work out if your project can be Exempt Development, our team has designed a simple and affordable platform to assist you.

To to be Exempt Development, in most cases, you project has to meet the requirements of NSW State Environmental Planning Policy (Exempt and Complying Development Codes) 2008.  You can either check the requirements here (strongly discouraged for your own sanity!) or use our self-assessment tool below for a small $33 fee to confirm that your project can be exempt.

However, note that if your project can’t meet the rules for this, the work will need a CDC or need a DA.  If this turns out to be the case, return to the Home page and choose the most suitable option.

To make it easy to confirm that your project falls within this category, we have broken the process up into 3 stages.

Stage 1 – Choose your project type.
Stage 2 – Check if your project is located on land where Exempt Development is not permitted.
Stage 3 – Check that your project can comply with the specific requirements for its category.

To ensure you aren’t wasting your time and money, a report will only be created once you have completed Stages 1 & 2. Once you have done this you will need to pay a nominal fee of $33 to complete Stage 3, where an Exempt Development report will be generated if your project can be Exempt.  To see an example of our Exempt Development report click here.
